This tutorial has been designed to help prospective business filers through the name reservation process set up by the Texas Secretary of State. In this state, name reservations cost a total of $40 and endure for a period of 120 days with the possibility of a 30 day renewal. The government website features an online filing system which can be used to reserve, however, this portal requires that those who use it first sign up for an account (registration tutorial found here). On top of the online reservation process, we’ve also relayed the paper filing method below and linked the appropriate PDF needed to file.
Before reservation, it is often a good idea to perform a name availability search to ensure that no other entity is currently operating under the name you’re attempting to reserve.
How to Reserve (Online)
Step 1- You must first log into your account before proceeding. To do so, navigate to this webpage, submit your login credentials and click Submit. If you don’t currently have an account, you may review our tutorial on account registration here.
Step 2- You will need to supply certain personal information before accessing the homepage. To start, enter your payment method and contact information into this page.
Step 3- Your payment information will need to be submitted next. They will ask that you include the following:
- Card type
- Card number
- Expiration date
- Security code
- Business name or individual name
- Full address
- Phone number
Step 4- Once everything has been supplied, you will be notified that you are currently logged in and will be provided with your session code. To advance to the business filing page, click on the Business Organizations tab in the top menu.
Step 5- On the homepage you should be able to locate the drop down menu which features the option of filing the Application for Name Reservation. Once selected, click File Document.
Step 6- On this page, select the name reservation option once again.
Step 7- Supply the name to be reserved here. You may also perform a Name Availability Search, which is always recommended to ensure that you aren’t filing a name that already exists.
Step 8- Supply the name of the business or individual that’s reserving followed by their address. Click Continue when ready.
Step 9- It is not required that you provide a letter of consent. Should you wish to do so, you may click Choose File and select the file from your computer. Otherwise, click Continue to skip this step.
Step 10- The signature of the applicant can be provided by typing your full name into the field and clicking Continue.
Step 11- The next page will show an image of the completed application. If all information on it seems to be correct, click the Submit Filing button to officially send the document to the Secretary of State and pay the filing fee.
How to Reserve (PDF)
Step 1- Filers may choose to reserve through the mail by downloading the Application for Reservation or Renewal of Reservation of an Entity Name.
Step 2- On this PDF, you will need to enter the following information:
- Whether it is a new application or a renewal
- Name to be reserved
- Entity type
- Name of applicant whether entity or individual
- Applicant address
- Signature of applicant
Step 3- With the form completed, you will be able to print it off, provide your signature and attach to it a check or money order totaling $40 (made out to the Secretary of State). You may also choose to pay by credit card by attaching this document and supplying the requisite information. Also, you must provide a duplicate of your filing form to be returned to you by the Secretary of State as evidence of filing. When all items have been consolidated you may send your filing in the mail to the first address below. The second location should be used should you decide to deliver it in person.
