As there is currently no online method of application available, filers will need to send their documents through the mail to register. The process is quite simple and can be accomplished by doing the following: fill out the Application for Authority in duplicate, attach the proper filing fee amount to the form, and mail both articles to the Secretary of State. The filing fee for foreign LLCs is quite expensive at $750, payable by check made out to the Secretary of State. For those who are unaware, registering a foreign LLC in South Dakota requires the entity to include a certificate of good standing/certificate of existence with their application.

Renewal – In order for your foreign entity to remain in good standing you must renew each year using the Secretary of State online portal. You will be required to navigate to this website before submitting the business ID needed to gain access to the online forms. A filing fee in the amount of $50 will be required to complete renewal.
