This brief tutorial will walk you through the process of reserving your business name in North Dakota. All that is required of you is to download the PDF of the application on this webpage, enter in all the required information and send it along to the Secretary of State with an attached filing fee of $10. This filing fee can be paid by check, or by credit card (voucher included in the PDF). As opposed to many states, in which the reservation period lasts a mere 60 days, the North Dakota state government has decided to allow for a 1 year reservation of any name after the submission of this document.
A Business Entity Search to check the availability of the name you plan on filing under is never a bad idea. This will ensure that you don’t go to the trouble of filing this form just to have it rejected on the grounds that the name is indistinguishable or “deceptively similar” to that of another business.
How to File
Step 1- You’re going to be able to download the Name Reservation Application here and open it up in the PDF reader of your choosing.
Step 2- You can then submit the following information:
- Type of business entity
- Name to be reserved
- Name of owner of reserved name
- Telephone number of owner
- Address of owner of reserved name
- Name of individual to contact about this document
- Email address
- Telephone number
Step 3- Once the form has been completed, you may then attach the filing fee in the form of a check made out to the Secretary of State. An alternative to this it to fill out the voucher found at the bottom of the PDF in which you can submit your name, address, phone number and credit card information. Send the filing to the below address or, if you’d prefer, you may submit it via fax to 701-328-2992.
