LLCs are not required, in Montana, to draft an operating agreement as part of their registration process. However, we highly recommend that an agreement be drafted regardless for the sake of the LLC’s organization and legitimacy. Banks and other financial institutions may feel hesitant to work with an LLC without an operating agreement, an internal document laying out the rules and regulations of the entity.
